These Terms of Service ("Terms") govern your use of our website at https://aiarchgenerator.com/ and our AI-powered architecture, interior design, and virtual staging services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our Services.

Definitions

• "We," "us," "our": Refers to AI Architecture Design Generator
• "You," "your," "user": Refers to the individual or entity using our Services
• "Content": Includes prompts, uploaded reference images, room photos, sketches, floor plans, generated images, staged renders, downloads, and related metadata
• "Account": Your registered account on our platform

Acceptance of Terms

By creating an account, accessing our website, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. You also represent that you are legally able to enter into a binding agreement.

Service Description

AI Architecture Design Generator provides AI-powered workflows for:

• Architecture concept generation
• Interior and exterior design visualization
• Virtual staging for empty or unfurnished spaces
• Color, mood board, and related design ideation tools
• Image storage, management, and downloads

We may add, remove, or modify features from time to time.

AI Output Notice and Disclaimer

Nature of AI-Generated Content

Our Services rely on third-party AI models and infrastructure providers (including, without limitation, fal.ai and the underlying Flux, Stable Diffusion, and similar generative models) to produce architecture, interior design, virtual staging, and editing outputs. AI generation is probabilistic; outputs may be imperfect, inaccurate, hallucinatory, repetitive, biased, structurally implausible, or unsuitable for your specific use case. We do not guarantee the quality, fitness, factual correctness, novelty, originality, or non-infringement of any generated output.

No Professional Advice

Generated outputs are provided for creative ideation and visualization purposes only. They are not architectural drawings, engineering documents, building plans, structural analyses, code-compliance assessments, surveying records, or legal advice. You must not rely on Generated Content for:

• Construction, fabrication, or structural decisions
• Building permits, zoning approval, code compliance, or any regulatory submission
• Real estate listings that misrepresent actual property condition, dimensions, or features
• Safety, fire, accessibility, or environmental assessments
• Final client deliverables without independent verification by a licensed professional
• Any decision where accuracy materially affects health, safety, finances, or legal status

You are solely responsible for reviewing every output and engaging qualified architects, engineers, surveyors, contractors, real estate professionals, or attorneys before using outputs in any of the above contexts.

Identifiable People, Brands, and Locations

You must not submit prompts or reference images that depict identifiable people without their consent, or that misappropriate trademarks, branded products, or recognizable real-world locations in misleading ways. We may decline or remove such requests.

Third-Party Model Terms

By using the Services you also agree to comply with the acceptable-use and content policies of the underlying AI providers we use (including fal.ai). Where third-party model terms are stricter than ours, those stricter terms apply to your use of the relevant feature.

Account Registration and Security

Account Creation

• You must provide accurate, current, and complete information during registration
• You must maintain and promptly update your account information
• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us promptly if you suspect unauthorized access to your account

Account Eligibility

• You must be at least 13 years of age to use our Services
• If you are under 18, you must have consent from a parent or legal guardian where required by law
• You must not use the Services if we have previously suspended or terminated your account for violations of these Terms

Acceptable Use

You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree not to:

• Violate any applicable law, regulation, or third-party right
• Upload or generate unlawful, abusive, hateful, fraudulent, defamatory, or infringing content
• Generate, request, upload, or share NSFW, sexually explicit, sexually suggestive, or sexually provocative content of any kind (see "Prohibited Content" below)
• Generate face-swap, deepfake, or face-manipulation outputs — including any altering, replacing, or impersonation of identifiable human faces (real or imagined) — regardless of consent or stated purpose
• Attempt to bypass, evade, or circumvent our content-moderation systems through encoded prompts, jailbreaks, prompt-injection, or similar techniques
• Use our Services to mislead others about factual property conditions, ownership, approvals, or compliance status
• Submit content that you do not own or do not have permission to use
• Attempt to reverse engineer, scrape, disrupt, or interfere with the Services or underlying systems
• Circumvent usage limits, payment controls, or account restrictions
• Use automated means to access the Services in a way that harms platform stability or other users

Prohibited Content

The following content is strictly prohibited on the Services regardless of subscription plan, model, or use case. Attempting to generate, request, upload, or share such content will result in immediate suspension or termination of your account, forfeiture of any stored assets, and may be reported to our payment processor (Creem) and to relevant authorities where required by law:

• NSFW, sexually explicit, sexually suggestive, or sexually provocative content — including nudity, pornography, fetish material, lingerie or "borderline" galleries, and any content that sexualizes a person regardless of age. This prohibition applies to prompts, uploaded reference images, generated outputs, gallery showcases, and any material submitted to the Services.
• Sexual content involving minors (CSAM) — strictly forbidden in all forms; reports will be made to NCMEC and to law enforcement without exception.
• Face-swap, deepfake, or face-manipulation content — generating, replacing, swapping, or altering identifiable human faces (whether of real persons, public figures, or impersonated identities) is prohibited regardless of consent, stated purpose, or apparent satire.
• Non-consensual intimate imagery — any depiction designed to harass, defame, intimidate, "out", or impersonate a real person.
• Content that bypasses safety filters — jailbreak prompts, prompt-injection attempts, encoded or obfuscated prompts, model-hopping, or any technique intended to circumvent our moderation pipeline.
• Hate speech, terrorist content, self-harm promotion, or violent extremism — including symbols, slogans, or imagery intended to incite or glorify any of the foregoing.
• Identifiable real persons without consent, copyrighted characters, or trademarks used in misleading or commercially unauthorized ways.

Content Moderation

All user-supplied prompts submitted to our image or video generation features are screened in real time by an AI content-moderation pipeline (currently provided by Creem) before being routed to any generative model. Prompts that are flagged or denied are blocked from generation and no credits are charged for blocked attempts. Repeated attempts to submit prohibited content, or any pattern of attempted moderation circumvention, will result in account termination and may be referred to our payment processor and to law-enforcement authorities where applicable. We do not market, advertise, or describe our Services using terms such as "uncensored," "no filter," "NSFW," "18+," or "unfiltered generation," and any third-party reference to our Services using such terms is not endorsed by us.

User Content

Content You Submit

You retain your rights in the content you submit to the Services. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, and transmit that content as needed to operate, secure, improve, and support the Services.

Content You Generate

Subject to these Terms and any applicable law, you retain your rights in the images and other outputs you generate through the Services. We may use generated content in aggregated or anonymized form for safety, abuse prevention, service improvement, and model or workflow evaluation. We will not claim ownership of your generated outputs solely because they were created using the Services.

Your Responsibilities

You are solely responsible for:

• The legality of the prompts, uploads, and content you submit
• Confirming that you have the rights needed for uploaded images and reference materials
• Reviewing generated outputs before relying on them
• Complying with any professional, client, or regulatory requirements that apply to your use case

Billing and Subscriptions

Pricing

• Current pricing is shown on our website
• We may change pricing at any time, but changes will not retroactively alter an already-paid billing period
• Promotional pricing, discounts, or trials may be subject to additional terms

Payment Processing

• Subscription fees are billed in advance on a recurring basis when applicable
• One-time purchases are billed at the time of checkout
• We use third-party payment processors, including Creem and other authorized providers
• We do not store complete payment card details on our own systems

Renewals and Cancellation

• Recurring subscriptions renew automatically on the same calendar day each billing period unless cancelled before the next renewal date
• You may cancel your subscription at any time through your billing settings or the Creem-hosted customer billing portal accessible from your account
• Cancellation stops future renewals; it does not automatically refund the current paid period (see Refund Policy below)
• After cancellation, your subscription benefits remain available until the end of the current paid billing period, after which your account reverts to the Free tier

Refund Policy

General rule: Subscription fees and one-time purchases are non-refundable once successfully charged, except as expressly described in this section or as required by applicable consumer-protection law in your jurisdiction.

Automatic credit refunds (no action required from you): Where a generation, edit, virtual staging, or related AI workflow fails because of a system-side issue — including, without limitation, AI provider 5xx errors, queue timeouts, infrastructure outages on our side, or detection-confirmed failures where the requested change did not occur — the corresponding usage credit or quota consumption is automatically refunded to your account at the time of failure. You do not need to file a refund request for these failures.

Subscription refund requests: We may, at our sole discretion, grant a partial or full subscription refund only when all of the following are true:

• The refund request is submitted to support@aiarchgenerator.com within 7 days of the charge in question
• The most recent billing period has had substantially no usage (we typically interpret this as fewer than 5 generations performed)
• The account has not previously received a discretionary refund for the same plan tier
• The account is not associated with abuse, chargeback history, or terms violations

What is never refundable:

• Usage already consumed (generations performed, virtual staging completed, downloads taken)
• Annual or multi-month plans where substantial use has occurred during the paid period
• Charges arising from your failure to cancel before a renewal you no longer wanted
• Promotional, discounted, or beta-period charges (specific terms of those offers control)
• Subjective dissatisfaction with the aesthetic quality or style of AI outputs (AI generation is probabilistic — see AI Output Notice)

Chargebacks: Initiating a chargeback or payment dispute through your card issuer or bank without first contacting us at support@aiarchgenerator.com is a violation of these Terms and may result in immediate suspension of your account, forfeiture of generated assets stored on our systems, and forwarding of your chargeback to the underlying payment processor (Creem) for evidence response.

Mandatory consumer rights: Where applicable law (for example, the EU/UK 14-day cooling-off right for distance contracts, or analogous local rules) grants you a non-waivable refund right, that statutory right applies regardless of this section, subject to the lawful exceptions for digital content where you have begun consuming the service.

How to request: Email support@aiarchgenerator.com from the account email address with your account email, the date and amount of the charge, and a brief description of the issue. We respond to refund requests within 5 business days.

Usage Limits

Different plans may include different limits for generations, downloads, virtual staging usage, storage, queue priority, or related features. We may enforce reasonable limits to protect the stability, fairness, and security of the Services.

Intellectual Property

The Services, including our software, branding, site design, and original platform materials, are owned by AI Architecture Design Generator or its licensors and are protected by applicable intellectual property laws. Except as expressly allowed under these Terms, you may not copy, resell, distribute, or create derivative works from the Services.

Suspension and Termination

We may suspend or terminate your access to the Services if:

• You violate these Terms
• Your use creates legal, security, abuse, or operational risk
• We are required to do so by law, regulation, or court order
• We discontinue the relevant part of the Services

You may stop using the Services at any time. Termination does not relieve you of outstanding payment obligations already incurred.

Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SUITABLE FOR YOUR SPECIFIC PROJECT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AI ARCHITECTURE DESIGN GENERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Indemnification

You agree to defend, indemnify, and hold harmless AI Architecture Design Generator, its affiliates, service providers, and licensors from and against claims, liabilities, damages, losses, and expenses arising out of or related to:

• Your use of the Services
• Your content
• Your violation of these Terms
• Your violation of any law or third-party right

Changes to These Terms

We may update these Terms from time to time. When we do, we will post the updated version on this page and update the effective date when appropriate. Continued use of the Services after an update becomes effective constitutes acceptance of the revised Terms.
